Welcome to the Battle Born Peptides Affiliate Program (“Program”). These Affiliate Program Terms and Conditions (“Agreement”) govern your participation in the Program. By joining, you (“Affiliate,” “you,” or “your”) agree to be bound by these terms. If you do not agree with any part of these terms, you must refrain from participating in the Program.
1. Enrollment and Approval
1.1 Eligibility
To participate in the Battle Born Peptides Affiliate Program, you must be at least 18 years old and legally able to enter into contracts. Affiliates may not promote products in ways that violate applicable laws or regulations.
1.2 Application Process
To become an Affiliate, you must apply through our online application process. Upon submission, we will review your application and may approve or reject it at our discretion. We reserve the right to deny approval for any reason, including but not limited to, if your website or marketing practices violate our Program guidelines.
1.3 Approval Notification
Upon acceptance into the Program, we will provide you with access to our affiliate portal, where you can generate your unique affiliate tracking link, view your commissions, and monitor performance.
2. Affiliate Responsibilities
2.1 Promotion of Products
Affiliates are responsible for promoting Battle Born Peptides products on their websites, social media, blogs, or other platforms, using their unique tracking links. Affiliates agree to promote our products for research purposes only, and not for human or animal consumption. Affiliates should not misrepresent the products or engage in deceptive marketing practices.
2.2 Compliance with Laws and Guidelines
Affiliates must comply with all applicable laws, including advertising laws and guidelines set by the Federal Trade Commission (FTC). This includes but is not limited to:
Proper disclosure of affiliate links in accordance with FTC guidelines (i.e., “This post contains affiliate links” or similar language).
Compliance with advertising laws regarding the promotion of research chemicals.
2.3 Prohibited Activities
Affiliates must not:
Use misleading or deceptive marketing practices.
Promote products to individuals or entities outside of the United States.
Engage in spam, paid search ads (PPC) using our brand name or product names, or violate any laws regarding email marketing.
Use any “Battle Born Peptides” trademarks in domain names, URLs, or misleading web addresses without our prior written consent.
Failure to comply with these rules may result in the termination of your affiliate account and forfeiture of any earned commissions.
3. Commissions and Payment Terms
3.1 Commission Structure
As an affiliate, you will earn a 10% commission on the total sales made through your unique affiliate link. Commissions will be paid only on completed sales and will be based on the net revenue received by Battle Born Peptides, excluding shipping fees, taxes, and refunds.
3.2 Affiliate Commission Payouts
Commissions will be calculated and paid on a monthly basis, and affiliates can expect to receive payouts for the prior month’s sales by the 15th of the following month.
3.3 Minimum Payout Threshold
The minimum payout threshold for commissions is $50. If your earned commissions are below $50 at the end of the month, your balance will carry over to the next month until you reach the $50 payout minimum.
3.4 Payment Methods
Payouts will be made via PayPal or direct bank transfer, depending on the option you select in your affiliate portal. You are responsible for ensuring that the payment information you provide is accurate and up-to-date.
3.5 Refunds and Chargebacks
Commissions earned on sales that are later refunded or charged back will be deducted from your affiliate balance. If an order is canceled or refunded, no commission will be paid on that sale.
4. Tracking and Reporting
4.1 Affiliate Dashboard
Affiliates will have access to a personalized affiliate dashboard where you can track clicks, conversions, and commissions. The tracking system is designed to ensure accurate reporting, but you are responsible for checking the dashboard regularly.
4.2 Tracking Links
Affiliates will be provided with a unique tracking link that tracks sales made through your affiliate marketing efforts. You are responsible for using this link in all of your promotional content, including blog posts, social media, and email newsletters.
4.3 Tracking Issues
If you notice discrepancies or tracking issues, please notify us immediately via info@battlebornresearch.com. We will review your account and work to resolve any technical issues promptly.
5. Affiliate Program Restrictions
5.1 Geographic Limitation
At this time, we only ship and sell to customers in the United States. Affiliates are prohibited from promoting our products in regions outside of the U.S. and must not target international markets for sales.
5.2 Intellectual Property
Affiliates are granted a non-exclusive, non-transferable right to use our trademarks, logos, and other promotional materials provided by us, solely for the purpose of promoting our products through the Affiliate Program. You may not use our intellectual property in any other manner without our prior written consent.
5.3 Termination of Agreement
Either party may terminate this Agreement at any time by providing written notice. Upon termination, you will no longer earn commissions on future sales, but commissions on sales made prior to termination will be paid, provided the sale is not refunded or canceled. Battle Born Peptides reserves the right to terminate your affiliate account for any violation of these terms, including fraudulent activity, deceptive marketing, or failure to comply with FTC guidelines.
6. Affiliate Program Changes
6.1 Modifications
We reserve the right to modify, suspend, or discontinue the Affiliate Program at any time. If any material changes are made to the Program, we will provide you with notice via email or through our affiliate portal. It is your responsibility to review any changes to the terms and conditions.
6.2 Commission Changes
Battle Born Peptides may change the commission structure or payout terms at any time. If changes are made, we will provide you with at least 30 days’ notice before the changes take effect.
7. Limitation of Liability
Battle Born Peptides will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the Affiliate Program or your participation in it. Our liability for any claim arising out of or related to the Affiliate Program will be limited to the amount of commissions actually paid to you in the month immediately preceding the event giving rise to the claim.
8. Miscellaneous Terms
8.1 Independent Contractor
You are an independent contractor and not an employee, agent, or partner of Battle Born Peptides. You have no authority to bind us in any contractual agreement.
8.2 Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the state of Florida, without regard to its conflict of law principles.
8.3 Severability
If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
